“Most participants use the option of writing a binding letter of agreement (or intention) before the mediation is over. So while the ideas and discussions during a mediation remain confidential and non-binding, you can in fact lock down your agreements the same day, a step we suggest.

Additionally, workplace mediation involves two or more parties who know each other and who often continue to work together. Goodwill is a powerful force of human nature. The commitments made at the conclusion of a mediation are expressions of goodwill. And goodwill goes a long way towards compliance.

Periodically some clarifications are required after the meeting. We recommend scheduling a phone call or video conference with the mediator to access the process and to clarify the direction they agreed to take.”
