“The union recognition vote is usually conducted by the NLRB - or an outside agency, such as an arbitrator or an election supervisor, who is responsible for ensuring the election is fair and impartial.

The election can take place in person, by mail, or through electronic means, depending on the circumstances.

During the union recognition vote, employees are presented with a ballot that includes the name of the union and the option to vote for or against union representation.

To be successful, the union must receive a majority of the votes cast in the election.

If the union wins the vote, it becomes the exclusive representative of the employees for purposes of collective bargaining, meaning that the union will negotiate with the employer on behalf of the employees regarding wages, benefits, and working conditions.

If the union loses the vote, it may be barred from seeking another election for a certain period of time, usually one year.

Please note: The union may still continue to organize and seek support from employees during this time, with the goal of eventually winning recognition in the future. Be sure to have a post-election communications and ER strategy regardless of the outcome.”
